2023

  • The foundation launches a new grant program - Modification of Hiking Trails and Cross-Country Ski Tracks.
  • In the Granting Wishes, Thinking of Others initiative, employees donated CZK 4.7 million to benefit 131 children and adults.

2022

  • An extraordinary employee fundraiser was held to help people affected by the war conflict in Ukraine.
  • The Foundation celebrates 20 years since its establishment.

  • An extraordinary employee fundraising campaign helped people and organizations affected by the tornado in South Moravia.

Information on personal data processing

Dear applicants, beneficiaries and business partners,

This document provides information on the conditions and circumstances of processing your personal data and the manner and scope of personal data processing by the ČEZ Foundation. This is also to inform you about the protection of personal data and your rights related to the processing of such data.

When processing your personal data, the ČEZ Foundation ensures compliance with European Union legislation, in particular compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data (the General Data Protection Regulation, hereinafter referred to as “GDPR”), which entered into force on May 25, 2018, as a directly applicable legal norm also within the legal system of the Czech Republic, as well as compliance with relevant national legislation, in particular the Personal Data Protection Act.

The protection of personal data is important to us. This information on personal data processing (hereinafter referred to as “Information”) explains what personal data the ČEZ Foundation collects about you as part of processing the application for a foundation contribution, the negotiation of the foundation contribution agreement and its use, and in connection with the provision of the "EPP" mobile application “Move to Help” or other business relationships between us.

The controller of your personal data is the ČEZ Foundation, having its registered office at Duhová 1531/3, 140 53 Praha 4, company reg. No.: 26721511, registered in the Commercial Register kept by the Municipal Court in Prague under file No. N 462 (hereinafter referred to as the “Foundation”).

We collect and process data primarily from representatives of applicants for foundation contributions, from recipients of foundation contributions if they are natural persons, or from representatives of recipients of foundation contributions if they are legal entities. We also collect and process personal data of service providers as our business partners. Depending on the specific situation, we also process the data of, for example, representatives of legal entities, including members of statutory governing bodies, or employees of our business partners. We also process personal, contact, and location data of users of the EPP—Move to Help application if the users of this application provide us with such data themselves.

The collection and processing of your personal data is necessary for the performance of the contract, to fulfill our legal obligations and, where applicable, to ensure the protection of our legitimate interests. We only process your personal data that is necessary for our fair mutual contractual and/or business cooperation.

In particular, the Foundation processes the following categories of personal data:

  • Basic data

Basic data

The Foundation considers the following to be basic data:

  • Identification data: title, name, surname, date of birth, ID card number or company reg. number, if applicable;
  • Contact data: permanent address, mailing or other contact address, phone number, e-mail address;
Other data

We also process data that arise from the nature of our cooperation or that you communicate to us in the course of our cooperation. In particular, we consider the following to be such other data:

  • Bank account number, signature, health data, location data, photographs;
  • Other personal data arising from the performance of a specific contract or a relevant legal regulation, or image or sound recordings.

Our Foundation uses the collected personal data mainly for the following purposes:

  • Negotiating the foundation contribution, conclusion and execution of the contract.
  • Keeping records of the foundation contributions made.
  • Concluding and executing a contract on business cooperation.
  • Keeping records of business partners.
  • Ensuring operational activities.
  • Accounting and tax purposes.
  • Operating the EPP—Move to Help mobile app.
  • Informing the relevant state authorities.

In practice, the following situations are the most common:

Preparing a contract for a foundation contribution or business cooperation

We collect and process only the data that is necessary and required for the drafting of such a contract. In order to conclude such a contract, we need to know your name, date of birth or company reg. number, and contact details. Additional related data depends on the type of business cooperation that is the subject of the contract.

Performance of the agreed contractual relationship

We have an interest in maintaining fair mutual relations, the fulfillment of the agreed contract and the related communications that are customary between contractual partners. In addition to our contractual relationships, your requests may also relate to the exercise of your rights in relation to data protection matters.

The reason why we process your data:

Accounting and taxes

We collect and process your identification and transaction data in order to comply with our accounting and tax obligations to regulatory and government authorities imposed by the Accounting Act, the VAT Act, and other Czech accounting and tax laws, and for mandatory reporting to regulatory authorities.

The reason why we process your data:

  • Compliance with legal obligations
EPP—Move to Help mobile application

We collect and process your identification, contact, and location data if you, as a user of this mobile application, provide us with such data. In other cases, we only collect anonymous location data of mobile devices without the possibility of identifying a specific user, for the purpose of collecting and subsequently allocating points as support for the ČEZ Foundation's Move to Help project.

In connection with assessing certain applications for foundation contributions, it may be useful to accompany such applications with the use of your photographs and other personal data beyond the need to negotiate a foundation contribution contract; however, this will not be possible without your consent. For example, in a situation where you as an individual are the intended recipient of such a contribution and the funds for such a contribution may be pooled by several persons, e.g. employees of the Concern or CEZ Group companies, on the basis of a separate decision, after your personal data is published on the Foundation's website or by using the EPP—Move to Help application.

These will usually be photographs in which you are clearly identifiable, accompanied by more detailed information about your person and, where appropriate, your health, and the use of this personal data may help to raise donations through internal or external communications aimed at potential donor associations.

We will notify you separately of such situations and offer you the opportunity to give our Foundation consent to use your specifically identified personal information for a specified purpose for a pre-determined period of time.

It is solely upon your discretion as to whether you give us your consent or decide otherwise. No such consent is conditional on the positive processing of your application for a foundation contribution and no one will force you to give consent in any way.

You may, of course, change your decision at any time and withdraw your consent in the manner notified to you in the text of the consent.

Our Foundation obtains your personal data primarily from you in the context of processing your application for a foundation contribution, or in the course of negotiations on the conclusion of a contract and in the course of its performance. Also by using the EPP—Move to Help application, if you allow us to do so in its settings.

We will always inform you when the provision of personal data is necessary for the provision of a foundation contribution and when it is voluntary, but the provision of such personal data will facilitate the mutual communication between the data subject and the Foundation and will also significantly improve the efficiency of the provision of services.

We may also obtain your personal data from representatives of applicants for foundation contributions, from representatives of recipients of foundation contributions, from public records, or from government authorities.

Personal data contained in public registers

In cases where we exercise our legitimate interests, in particular our interest to act with due care, we may also obtain your basic data and certain other data from public registers such as the trade register, the land register, and similar.

The Foundation processes your data manually and automatically. However, we do not use automated decision-making that could affect your rights when processing your data automatically.

The protection of your data at the Foundation is organizationally and technically secured in accordance with the relevant legislation. We require a comparable level of security for your data from all our data processors.

In addition to our Foundation and its employees, your personal data may also be processed by certain other CEZ Concern companies or other companies as processors of your data for the purposes described above. We transfer your data to these companies or entities only if they meet the organizational and technical conditions defined by us to ensure their proper protection. Furthermore, they are contractually obliged to comply with the agreed conditions for processing your data and ensuring the specified protection. Such processing of your personal data may take place without your consent.

  • Archive service providers.
  • Alternative suppliers or service providers.
  • Providers or recipients of services related to the performance of the Foundation's contractual or legal obligations.
COOKIES

Cookies are primarily used on our Foundation's website to analyze traffic. In particular, we share information about how you use our website with our parent company, ČEZ, a. s. Details about the setting of cookies and their functions, including granting or withdrawing your consent to their use, are available in the Website Information.

RECIPIENTS OF PERSONAL DATA AND REQUESTS WITHOUT CONSENT

Certain government authorities and other organizations are entitled to request information about you, in particular the Tax Office, the courts, prosecutors, and the Police. We only provide your data if we are obliged to do so by the relevant act.

Protecting and securing your personal data is an important goal of our company. We use various technologies, practices, and processes to protect your personal information from unauthorized access, use, and disclosure. For example, we process the personal information you provide on computer systems and store it in restricted access data storage facilities located in secure buildings. For transmissions of personal data with a high degree of confidentiality (such as bank account numbers or passwords) in an Internet environment, we use data encryption for protection.

Personal data collected by our Foundation is processed and stored exclusively in Czechia.

Our Foundation retains your personal data for as long as necessary to complete the agreed transactions or for other necessary purposes, such as compliance with our legal obligations, contractual obligations, dispute resolution, and legal enforcement of contractual obligations or for any administrative proceedings. These needs vary depending on the type of contractual relationship we have entered into and therefore the actual retention period may differ significantly.

We respect the rules of data minimization when handling your data for specific purposes. That is, we only collect your data that we absolutely need for a specific purpose. At the same time, we set strict internal archiving rules to ensure that we do not keep this information about you for longer than we are entitled to.

For a large part of our contractual relationships, we have to provide evidence of the calculation and payment of taxes arising from the legislation governing the different types of taxes and the related tax procedures. Under this legislation, we are required to keep tax documents and records detailing the tax data relating to the selected services provided for 10 years from the end of the tax year in which the transaction took place. In general, we are obliged to keep most of the basic data and information about our contractual relationships on the basis of this legislation.

In cases of applications for which a foundation grant has not been approved, we retain personal data for four years after the rejection. Where an application has been approved and a contract has been negotiated for a foundation grant, we retain personal data for the duration of the contractual relationship and then for four years after its termination.

If we process personal data on the basis of your consent, we keep the data for as long as the consent is validly granted. For the avoidance of doubt, we retain the consent itself and any amendment or withdrawal of your consent on the grounds of our legitimate interests for the duration of the consent and for a maximum of 5 years after it has lapsed.

Our Foundation strives to process your personal data in a transparent and fair manner and to ensure that it is properly protected, always in accordance with the relevant legislation. To assure you of our responsible approach to the processing of your data, we are ready to respond quickly and professionally to your legitimate requests to verify our responsibility in processing your data and, where appropriate, to help us rectify any shortcomings in this activity, should they exceptionally occur.

  • If the processing of personal data is based on your consent, you shall be entitled to withdraw your consent for future processing at any time.
  • You shall be entitled to request access to your personal data and more detailed information about its processing from us as data controller.
  • You shall be entitled to request from us the rectification of inaccurate or incomplete personal data.
  • You shall be entitled to request us to provide your personal data in a commonly used and machine-readable format that enables it to be transmitted to another controller, where we have obtained it on the basis of your consent or in connection with the conclusion and performance of a contract and it is processed by automated means.
  • You shall be entitled to object to the processing of some or all of your personal data.
  • You shall be entitled to request us to erase your personal data if we no longer have any legal basis for further processing and
  • You shall be entitled to file a complaint with the Office for Personal Data Protection.

If we process your personal data, we do so on the basis of the relevant legal grounds enabling the provision of foundation contributions, the operation of the EPP—Move to Help mobile app, the operation of our Foundation, the performance of our contractual and legal obligations, ensuring the protection and security of our systems and the data of our beneficiaries, or the pursuit of other legitimate interests of our Foundation as described in the above sections of the Information. Alternatively, we process your personal data on the basis of your consent where you provide it to us.

Despite our best efforts to make this document as clear as possible, you may find words or terms you have not come across before. Or you may not be sure that you understand what they are intended to tell you.

Therefore, to help you better understand, based on our experience, we offer a glossary of terms that may help avoid any misunderstandings:

CEZ Concern

A legal relationship between several CEZ Group companies (controlled companies), which are subject to unified management by ČEZ, a. s. (the controlling company), with which they form a concern through unified management. Legitimate interest

The interest of the controller or a third party, for example, in a situation where the data subject is a customer or business partner of the controller.

Personal data

Information about a specific, identifiable person.

Recipient

The entity to whom the personal data is transferred.

CEZ Group

CEZ Group comprises several companies grouped around the parent company ČEZ, a. s., operating mainly in the energy sector, linked to the parent company mainly through equity holdings. Further information is available at www.cez.cz/cs/o-spolecnosti/skupina-cez/o-skupine-cez/profil-skupiny-cez.html

Controller

The entity that determines the purpose and means of processing personal data; it may also decide to entrust the processing of personal data to another entity as a processor.

Data subject

A living natural person whose personal data is the subject of processing.

Purpose

The reason for which the controller uses your personal data.

Processing

The activity which the controller or processor carries out with personal data.

Processor

An entity that processes personal data for the controller.

Over time, there may be changes to the legislation governing the rules and conditions for processing and protecting your personal data, or changes to our terms, conditions, procedures, and methods for processing and protecting your personal data. We will always inform you of these changes by updating this Information, unless the change in question requires us to also notify you by individual communication (by letter or electronic message).

If you have a request or grievance regarding the processing of your personal data or a question about the person responsible for the processing of personal data in our company, please contact us at poverenec.koncern@cez.cz. We will respond to your requests, questions, or grievances as soon as possible, but no later than one month after receipt. If we are unable to deal with your request in a timely manner due to the complexity of your request or the high number of requests from other persons, we will inform you of the necessary time extension.
